Description of Service
COAP Online Ltd. (“COAP”, “COAP Online”, “we”, “us” or “our”) provides a platform via its COAP Online website (the “Site”) to a community of registered users (“users” or “you”) and paid member (“members”) to engage in a variety of activities, including to upload and display photographs (“Visual Content”), share comments, opinions, and ideas, engage in specific interest groups, participate in contests and promotions, register for premium membership accounts (“membership”), undertake online learning courses and live workshops, interviews and discussions. The foregoing list of Services is not all-inclusive and additional Services may be offered by us from time to time. The following are the terms of use (“Terms”) for using the Site and the Services.
SUMMARY: This is a platform specifically catering for aviation photographers to display their work online and engage in community. We provide services to create online portfolios, to inspire and be inspired, learn new skills and enjoy entertainment features. More features will be added in the future.
YOUR ACCEPTANCE
BY REGISTERING TO USE THE SERVICES OR JOIN AS A MEMBER, YOU AGREE TO COMPLY WITH AND BE LEGALLY BOUND TO THESE TERMS AND PRIVACY POLICY AND ALL RELEVANT LAWS. IF YOU DO NOT AGREE WITH THE TERMS YOU MUST CANCEL YOUR REGISTRATION AND/OR MEMBERSHIP, CEASE USING THE PLATFORM AND ALL OTHER SERVICES.
SUMMARY: By using COAP Online, you agree to all the terms below.
CHANGES TO THE TERMS
COAP reserves the right, at its sole discretion, to modify or replace the Terms at any time. If this results in a significant change to the Terms, COAP will notify you by e-mail. Whether or not a change is deemed significant or not will be determined by COAP alone and it is your responsibility to familiarise yourself with any changes and your use thereof constitutes your acceptance. You are also subject to specific guidelines posted within any specific element of the Services.
The Site and our Services will be subject to maintenance at times, for such things as development, malfunction, updates, repair or any other reason outside of our control. COAP reserves the right to suspend Site availability or continuation of the Site and any Service, or impose limits on certain features or restrict access, and to remove any Content at any time at its sole discretion and without prior notice. The site should not be used as a storage facility nor relied upon for storage of images and you are instructed to retain your own original images.
SUMMARY: If things change, we will notify you. Things can go wrong and services may be interrupted. Don’t use this as an image storage facility and back your images up.
REGISTRATION
COAP Online is open to all aviation photographers on an invite-only basis. In order to use the Services, you need to be invited to create an account, select a password and username, and to provide registration information including a valid email address. You will also be asked a series of questions to validate your interest in order to maintain a high standard of community values and engagement. The registration information you provide must be accurate, complete, and current. If you fail to do so, it will be deemed as a breach of the Terms, which may result in the termination of your account and access suspended. All personal information provided is governed by the COAP Privacy Policy.
You may not use any account details of another person, the name of a trademark or any other entity without appropriate authorisation – nor may any details be offensive, vulgar or obscene. You are responsible for your own privacy of your password.
Services are available to anyone that is over 18 (or at least 14 years old with authorisation from parent or legal guardian. If you have authorised a minor to use the Site, you are responsible for the online conduct of said minor and the misuse consequences thereof. Parents and legal guardians are advised that whilst no nudity, vulgarity or obscene content is permissible, there may be occasions where language might be offensive to some.
You may only upload your own content, unless specifically to illustrate a point (especially in the Hangouts area to illustrate a learning point) and any such content must be clearly indicated and credited. No image sharing for the sake of attention, no plagiarism, no copyright infringements, no intellectual property breaches.
SUMMARY: To fully use the services, you need to create your own account or join as a member, without violating other people’s rights at any time.
ON-SITE CONDUCT
All content (image-based content or text-based comments and discussions) is the sole responsibility of the account holder. You acknowledge that you, not COAP, is entirely responsible for all content (including in any messages exchanged). COAP does not control user-submitted content and cannot guarantee content accuracy, integrity or quality.
As a condition of use, you must abide by the Terms and not use the Site or Services for any unlawful or prohibitive manner, or any other purpose not reasonably intended by COAP.
You explicitly agree to the following…
1) Not to abuse, intimidate, harass, bully, intimidate or impersonate anyone.
2) Not to post or cause post of any libellous, defamatory, obscene, pornographic, abusive, profane, offensive or copyright-protected content.
3) Not to communicate with COAP in any abusive or offensive manner.
4) Not to attempt to gather any personal information from other users.
5) Not to create unwanted spam to any person, entity or website.
6) Not to post any copyrighted content that does not belong to you, unless being used to illustrate a constructive or educational point, and whereby such posts are appropriately attributed to the owner and source.
7) Not to access the site using any automated means for any purpose without our written permission. Also not to add any large load upon the site, nor interfere with the working of the site, or bypass any access measures to use the site.
8) To artificially use any means to increase the number of inspired points or engagement in any content.
9) To advertise or solicit any third party products or services, or use any information contained in the site or users to contact, advertise, solicit or sell without explicit prior consent.
10) To sell or otherwise transfer your profile or account.
11) No image stealing, no reposting, no re-sharing, no downloading for your own use, no screenshots for re-posting on any platform, anywhere, ever. Adherence to Intellectual Property and Copyright Laws are vital on this platform.
12) Any other significant misdemeanour noted on COAP Online that is deemed to be against the pursuit of aviation photography, the community and the enjoyment thereof that is not covered above.
If you need to report a breach of any of these (or any other matter), although there are various reporting tools across the Site, we advise you to send written notice to COAP by e-mail to contact@coaponline.com
You are solely responsible for your interactions with other users of the Site. COAP reserves the right, but has no obligation, to review disputes between you and other users. This includes the right to review messages exchanged if such interaction is deemed to breach the Terms in any way.
If the site is used in any way that violates the Terms, COAP reserves the right to suspend or terminate any user account at any time, or disable access to certain areas, and take further action if required that is appropriate to the situation.
SUMMARY: You must follow the Terms and you can’t use the site for any purpose other than what it was designed for. No offensive material or intimidation, bullying or spamming. Just be nice, proactive and helpful and it’ll be great.
COAP ONLINE MEMBERSHIP SERVICES
COAP provides member services to holders of its paid Membership account. After a membership purchase, these services are ‘unlocked’ and able to be used on an unlimited basis for the lifetime of your membership. In addition to the general terms and conditions provided for by these Terms, the following terms and conditions apply specifically to Membership holders:
1) Services available to Members are described on the Join Now page. Memberships are available on an annual and monthly membership basis.
2) COAP may modify, suspend, or discontinue the Services provided to Membership holders at any time at its sole discretion and without prior notice or providing any refund for any fees paid.
3) You can cancel your renewals at any time on your account settings page. You will have access to your membership until the expiry date. After that date you will be downgraded to a free membership. Refunds are only eligible for yearly memberships within 30 days of the initial purchase. After 30 days, all memberships are non-refundable.
4) We do not provide refunds on monthly subscription payments. Once you cancel your monthly payment, you will maintain access to your upgraded features for 30 days after your final payment has cleared.
SUMMARY: The paid services available are outlined on the Join Now page. Members can cancel their recurring subscriptions at any time.
IMAGE-BASED CONTENT
1) You are the sole and exclusive owner of all rights, including all copyrights in and to all content you submit to the Site and that the content has not been designated as being in the public domain nor created or belonging to another photographer or artist.
2) You are not violating or breaching any agreement with any other party by submitting content to COAP Online.
3) The content is original and it does not infringe the copyright of any third party, and will not contain any matter which violates any applicable law, rule or regulation and will not defame, violate the right or privacy or publicity, or infringe the trademark, intellectual property rights or proprietary rights, of any third party.
4) The content does not include any material that would be considered to be obscene or pornographic, offensive or vulgar.
5) Any caption information, keywords, metadata, copyright management information or other information submitted with the content relevant, accurate, and complete, and does not contain false or misleading information.
6) The content does not contain any viruses, spyware, Trojan horses, time bombs, or other similar harmful or deleterious programming routines or code.
SUMMARY: Your photos are your copyright and will remain so. They do not belong to COAP. We do not own or have the right to re-use or sell your material. If an image has a possible use as a promotional image, we will always ask for permission, and you may or may not grant it. Don’t steal other people’s hard work. Don’t steal other people’s hard work.

COPYRIGHT PROTECTION & COMPLAINTS
Your images are your copyright. COAP reserves the right to remove any Content that allegedly infringes another person’s copyright. In appropriate circumstances, COAP will terminate the accounts of users who infringe copyright. Notices regarding any alleged copyright infringement on this site should be marked accordingly using the Site reporting tools and then reported to COAP via email at: contact@coaponline.com
You will be asked to provide the following…
a. Your name, address, telephone number, and email address.
b. A description of the copyrighted work that you claim has been infringed;
c. A description of where on the Site the material that you claim is infringing may be found, sufficient for COAP to locate the material (e.g., the URL);
d. A statement that you have a good faith belief that the use of the copyrighted work is not authorised by you, your agents, or the law and is not a fair use;
e. A statement by you binding that the information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner’s behalf; and
f. Your electronic or physical signature.
This will then be dealt with on an individual claim by claim basis towards legal resolution.

Links to other sites and resources may often be provided in the delivery or posting of content. COAP does not have any control over such sites and resources and is therefore not responsible or liable for any content, advertising, products, or any other material on or available from such sites or resources. You also agree that COAP shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such site or resource.

RELEASE AND INDEMNITY
You hereby expressly and irrevocably release and forever discharge COAP, any affiliated and associated companies and its authorised distributors, and their respective directors, officers, employees, agents, representatives, volunteers, independent and dependent contractors, licensees, successors and assigns of and from any and all actions, causes of action, suits, proceedings, liability, debts, judgments, claims, and demands whatsoever in law or equity which you ever had, now have, or hereafter can, shall or may have, for or by reason of, or arising directly or indirectly out of your use of the Site and the Services.
You hereby agree to indemnify and hold harmless COAP, its affiliated and associated companies and its authorised distributors, and their respective directors, officers, employees, agents, representatives, volunteers, independent and dependent contractors, licensees, successors and assigns from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary, and indirect damages), and reasonable lawyer’s fees, resulting from or arising out of (i) a breach of these Terms, (ii) Content posted on the Site, (iii) the use of the Services or Memberships, by you or any person using your account or COAP Username and password, (iv) the posting of your visual and text content, or (v) any violation of any rights of a third party. COAP reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you.

TRADEMARKS
The Centre of Aviation Photography, COAP, COAP Online, Aviation Creatives and all other COAP graphics, logos, designs, phrases, slogans, page headers, button icons, scripts, divisions and service names are trademarks, brands or trade dress of The Centre of Aviation Photography Ltd and COAP Online Ltd. COAP’s trademarks and associated logos or phrases may not be used in connection with any product or service without the prior written consent of COAP.
SUMMARY: Please respect our brands, designs, phrases, slogans, and trademarks.
CLOSING YOU ACCOUNT
COAP may terminate or suspend any and all Services and/or your COAP Online account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your COAP account, you must do so in writing and select whether you wish to deactivate (i.e., temporarily suspend) or completely delete your account. Either way, your visual content will no longer appear on the Site pursuant to these Terms.
It is your responsibility to retain originals of your content because all material on your account will no longer be available after termination. However, your content will remain dormant if you are deactivating your account and will still be there when you re-activate. We may opt to remove the option to temporarily deactivate an account at any time.
SUMMARY: You can also stop using your account or close your account at any time. We can cease services at any time.

YOUR USE OF THE SITE AND THE SERVICES IS AT YOUR OWN RISK. THE SITE AND THE SERVICES ARE PROVIDED ON AN “AS IS, AS AVAILABLE” BASIS. Your Rights Under the GDPR
